Making Money Tips

RINO conspiracy?

Federal authorities have opened a criminal investigation of Delaware Republican Christine O’Donnell to determine if the former Senate candidate broke the law by using campaign money to pay personal expenses, according to a person with knowledge of the investigation.

The person spoke to The Associated Press on condition of anonymity to protect the identity of a client who has been questioned as part of the probe. The case, which has been assigned to two federal prosecutors and two FBI agents in Delaware, has not been brought before a grand jury…

At least two former campaign workers have alleged that she routinely used political contributions to pay her personal expenses in recent years as she ran for the Senate three consecutive times, starting in 2006. The Washington-based watchdog group Citizens for Responsibility and Ethics (CREW) filed a complaint with the Federal Election Commission making similar allegations and asked Delaware’s federal prosecutor to investigate…

During her three failed Senate bids, O’Donnell had numerous campaign treasurers, many of who left after serving brief stints. After losing two treasurers in 2009, she named herself treasurer until this past summer. Another short-term treasurer took over in August and resigned less than two months later, when Moran added the treasurer’s role to his campaign manager responsibilities.

A “top Delaware Republican” confirmed the fact of the investigation to Politico, although it’s worth noting that the state GOP once filed its own FEC complaint against her for accepting contributions from the Tea Party Express ahead of September’s RINOgeddon primary with establishment fave Mike Castle. Here’s CREW’s press release from September touting their complaint against her; their chief witness is a former aide who claims she used campaign money to pay for meals, gas, and even a few months of rent. (O’Donnell’s camp claims she was using the apartment as her campaign HQ, but the AP counters that that wouldn’t necessarily let her off the hook.) Another former aide also claimed before the primary that she lived off campaign money in 2008 — although that same aide ended up recording a robocall for the Castle-supporting GOP. This issue came up too in John McCormack’s interview with O’Donnell in September, serving as a springboard for her now-famous digression about operatives sent by her opponents following her home and hiding in the bushes to harass her.

Team O’Donnell’s response to the charges? From a blast e-mail sent this afternoon:

Campaign Manager Matt Moran responded to the rumor of a criminal investigation, “We have heard absolutely nothing other than the same unsubstantiated allegations and rumors that have been circulating in the press for months. If anything does materialize from this rumor, we will continue to fully cooperate as we have made every attempt to ensure we are in compliance with all rules and regulations. The politically motivated charge was all started by false accusations by Christine’s political opponents, and ratcheted up by former Biden staffer Melanie Sloan and CREW with their false claims. Let us be clear: there was no impermissible use of campaign funds. Period. This is just an ongoing effort by the George Soros-funded CREW and other liberal groups and individuals to intimidate and threaten Christine, even after the election.”

Christine O’Donnell continued, “Since anonymous sources are being taken seriously, please allow me to share some tips I’ve received and keep the tipsters’ identities anonymous. We’ve been warned by multiple high-ranking Democrat insiders that the Delaware Democrat and Republican political establishment is jointly planning to pull out all the stops to ensure I would never again upset the apple cart. Specifically they told me the plan was to crush me with investigations, lawsuits and false accusations so that my political reputation would become so toxic no one would ever get behind me. I was warned by numerous sources that the DE political establishment is going to use every resource available to them. So given that the King of the Delaware Political Establishment just so happens to be the Vice President of the most liberal Presidential administration in U.S. history, it is no surprise that misuse and abuse of the FBI would not be off the table. And further connecting the dots, do you think it is just a coincidence that Melanie Sloan was a senior Biden staffer just before she joined CREW and filed her complaint against me?!

“I have faith that our supporters and the general public will see right through these thug tactics. This is simply an Establishment trick to stop the anti-establishment Tea Party movement in its tracks. Heck, the Presidency is at stake in 2012.”

Emphases mine. In other words, as McCormack puts it, she thinks Joe Biden is out to get her. Two questions. First, given the fact that a total zero like Chris Coons managed to pull off a landslide win in a year characterized by huge Republican gains, why would Democrats want to make sure that O’Donnell could “never again upset the apple cart”? She’s their preferred Republican nominee forevermore, I’m sure. And second, does O’Donnell actually … believe any of this? The vice president’s going to take down the tea party by pursuing an FBI investigation against a candidate whom conservatives have already discarded? Alas, Marco Rubio, Rand Paul, and Mike Lee, we hardly knew ye.

The situation is a bit different if what is in dispute is a house. Obviously, the house cannot usually just be sold to repay a Legal Aid bill (it may be home to children) so what happens therefore is that the board will attach what is known as a "Statutory Charge" to the house in respect of monies owing. This means that when the house is sold or re-mortgaged then the Board will get their money. It is not a free loan however. Interest attaches to the charge and continues to accrue. It is rare for the board to agree to postpone their charge in the event that the house is eventually sold or is perhaps re mortgaged in the interim but they will consider it. As I stated earlier, there is no "free lunch".

Ways of Making Money

Maybe I’ve been wrong all along. Maybe it really is time for a third party.

Though Mr. Kirk and other Republicans thundered against pork-barrel spending and lawmakers’ practice of designating money for special projects through earmarks, they have not shied from using a less-well-known process called lettermarking to try to direct money to projects in their home districts…

Lettermarking, which takes place outside the Congressional appropriations process, is one of the many ways that legislators who support a ban on earmarks try to direct money back home.

In phonemarking, a lawmaker calls an agency to request financing for a project. More indirectly, members of Congress make use of what are known as soft earmarks, which involve making suggestions about where money should be directed, instead of explicitly instructing agencies to finance a project. Members also push for increases in financing of certain accounts in a federal agency’s budget and then forcefully request that the agency spend the money on the members’ pet project…

[A] New York Times review of letters and e-mail to government agencies from members of Congress shows that the practice is widespread despite the fact that both President George W. Bush and President Obama have issued executive orders instructing agencies not to finance projects based on communications from Congress.

According to the Times, there’s basically no way to track these requests short of using FOIA to demand correspondence between Congress and various agencies. Another fun fact: Both Obama and Bush issued executive orders instructing agencies not to fund projects based on requests from individual congressmen — and yet, oddly enough, the Times claims the practice is “widespread.” Why do you suppose that is? Why might an agency head, whose budget depends on congressional appropriations, feel compelled to comply with “requests” from individual representatives for a few million dollars of pork here and there?

What’s most depressing about this, I think, isn’t the betrayal of transparency or even the hypocrisy of being loudly anti-earmark yet quietly pro-lettermark, it’s that it’s yet another example of government trying to do an end-around recently imposed limits on its own power. In this case, that limit was self-imposed by the GOP’s pledge to end earmarks; in the case of last night’s post about countermeasures to executive regulations, that limit was imposed on the White House by voters who chose divided government in November. And yet the GOP presses ahead with lettermarks and Obama presses ahead with pursuing his agenda by ignoring Congress to whatever extent he can. Nothing illegal about either, but they’re proof that not even a giant midterm landslide is enough of a signal to convince some pols to change their ways. Some “representation.”

Incidentally, since we’ve been arguing lately about whether the House of Representatives should be expanded, take a minute to read this smart Jay Cost post about how a bigger House could also mean more pork. The more districts we have, the smaller and more parochial they’ll get, which could be a huge benefit to incumbents who are willing and able to deliver lucrative earmarks back home.

1. If they see a obstacle, they just ignore it and run it over.

2. What's yours, is them to copy it.

3. Humans are nothing more then cheap slaves.

4. More is More.

5. The great wall of China is build on bones, and they would build it again on bones if it would turn out a profit.

6. When you do business with the Chinese, you're fucked either way to turn it.

The best reference ever of the Chinese was in Deep Space 9: The Chinese where portraied by the Ferengi and their 'Rules of Acquisition'

  1. Once you have their money ... never give it back.

  2. Never pay more for an acquisition than you have to.

  3. Never allow family to stand in the way of opportunity.

  4. A man is only worth the sum of his possessions. (From Enterprise, episode "Acquisition"; sloppy script-writing, as rule 6 (see above) was already given in DS9)

  5. Keep your ears open.

  6. Small print leads to large risk.

  7. Opportunity plus instinct equals profit.

  8. Greed is eternal.

  9. Anything worth doing is worth doing for money.

  10. A deal is a deal ... until a better one comes along.

  11. A contract is a contract is a contract (but only between Ferengi).

  12. A Ferengi without profit is no Ferengi at all.

  13. Satisfaction is not guaranteed.

  14. Never place friendship above profit.

  15. A wise man can hear profit in the wind.

  16. Nothing is more important than your health--except for your money.

  17. There's nothing more dangerous than an honest businessman.

  18. Never make fun of a Ferengi's mother ... insult something he cares about instead.

  19. It never hurts to suck up to the boss.

  20. Peace is good for business.

  21. War is good for business.

  22. She can touch your lobes but never your latinum.

  23. Profit is its own reward.

  24. Never confuse wisdom with luck.

  25. Expand, or die.

  26. Don't trust a man wearing a better suit than your own.

  27. The bigger the smile, the sharper the knife.

  28. Never ask when you can take.

  29. Good customers are as rare as latinum -- treasure them.

  30. There is no substitute for success.

  31. Free advice is seldom cheap.

  32. Keep your lies consistent.

  33. The riskier the road, the greater the profit.

  34. Win or lose, there's always Hyperian beetle snuff.

  35. Home is where the heart is ... but the stars are made of latinum.

  36. Every once in a while, declare peace. It confuses the hell out of your enemies.

  37. Beware of the Vulcan greed for knowledge.

  38. The flimsier the product, the higher the price.

  39. Never let the competition know what you're thinking.

  40. Ask not what your profits can do for you, but what you can do for your profits.

  41. Females and finances don't mix.

  42. Enough ... is never enough.

  43. Trust is the biggest liability of all.

  44. Nature decays, but latinum lasts forever.

  45. Sleep can interfere with profit. (DS9 season 2, episode 7 - "Rules of Acquisition")

  46. Faith moves mountains ... of inventory.

  47. There is no honour in poverty.

  48. Dignity and an empty sack is worth the sack.

  49. Treat people in your debt like family ... exploit them.

  50. Never have sex with the boss's sister.

  51. Always have sex with the boss.

  52. You can't free a fish from water.

  53. Everything is for sale, even friendship.

  54. Even a blind man can recognize the glow of latinum.

  55. Wives serve, brothers inherit.

  56. Only fools pay retail.

  57. There's nothing wrong with charity ... as long as it winds up in your pocket.

  58. Even in the worst of times someone turns a profit.

  59. Know your enemies ... but do business with them always.

  60. Not even dishonesty can tarnish the shine of profit.

  61. Let others keep their reputation. You keep their money.

  62. Never cheat a Klingon ... unless you're sure you can get away with it.

  63. It's always good business to know about new customers before they walk in the door.

  64. The justification for profit is profit.

  65. New customers are like razortoothed grubworms. They can be succulent, but sometimes they can bite back.

  66. Employees are rungs on the ladder of success. Don't hesitate to step on them.

  67. Never begin a negotiation on an empty stomach.

  68. Always know what you're buying.

  69. Beware the man who doesn't make time for oo-mox.

  70. Latinum lasts longer than lust.

  71. You can't buy fate.

  72. Never be afraid to mislabel a product.

  73. More is good ... all is better.

  74. A wife is a luxury ... a smart accountant is a necessity.

  75. A wealthy man can afford anything except a conscience.

  76. Never allow doubt to tarnish your love of latinum.

  77. When in doubt, lie.

  78. Deep down everyone's a Ferengi.

  79. No good deed ever goes unpunished.

  80. [Quark's rule] When Morn leaves, it's all over.

Until this week, the lies about death panels were some of the worst spread by Sarah Palin and the Republicans to scare seniors about health care reform and the Affordable Care Act (ACA). Now there's a real death panel, and John Boehner is in charge -- it's the Republican legislative campaign to undermine the ACA. Boehner and the Republicans want to give our health care back to the insurance companies, kill strong consumer protections that end the worst insurance company abuses and sentence more than 30,000 Americans a year to death because they can't afford health insurance.

As one of the first acts of the 112th Congress, the Republicans plan to repeal the Affordable Care Act and all the benefits and consumer protections that are making a real difference in the lives of millions of Americans right now. What are they replacing it with? Nothing. They're referring that question to a bunch of committees that will deliberate for months and play political football with our lives and health. What does that really mean? It means letting the insurance companies off the hook so they can run roughshod over consumers and deny our care and jack up our rates whenever they please.

Here are some of the things that will happen in the real world if the Republicans are successful with repeal:

  • Seniors who received $250 checks from Medicare last year to help buy prescription drugs will have to return the money to the Treasury Department.

  • Seniors will lose the 50% discount on brand-name drugs when they have reached the "donut hole" of their prescription-drug plans - a benefit worth more than $12,500 over 10 years to those who qualify. Instead of closing over the next several years, the "donut hole" will stay open permanently.

  • Seniors will stop receiving no-cost annual physicals, mammograms and cancer screenings under rules that had just taken effect this week. Also, a voluntary program to enable seniors to live independently would be wiped out, forcing more people to crowd into nursing homes.

  • Millions of consumers, including children, will be denied coverage and care due to pre-existing conditions and branded "uninsurable." Health plans will go back to kicking young adults off their parents' coverage instead of providing benefits until age 26.

  • Many Americans with sick family members will be forced to file for bankruptcy protection when insurers restore lifetime and annual caps on benefits.

  • Health plan premiums will resume their double-digit increases as insurers return to grabbing however much they want from your premiums to pay for excessive profits, CEO pay, an army of lobbyists and a bureaucracy that turns away the sick. New programs to block unreasonable rate hikes would be dismantled.

  • Taxpayers would pay hundreds of billions of dollars in excessive fees to private health insurance companies that enroll seniors in Medicare Advantage plans at much higher costs than if the government provided benefits directly. The Medicare trust fund's projected solvency will give back the 10-year extension it got from the ACA.

You can see an excellent overview here of what we will lose if the ACA is repealed. You can also see the district-by-district impact of health reform here.

After a century of legislative and political combat, working families and small businesses finally won and ended the insurance companies' stranglehold over our health care. Naturally, Boehner wants to roll back the new health care law and let the health insurance companies resume their reign of terror. That's why Boehner and his band of corporate shills, including House Majority Leader Eric Cantor, Senate Minority Leader Mitch McConnell and a raft of presidential wannabes, have made repealing the law the Republican Party's top priority for 2011.

The Congress needs to fix the economy and create millions of jobs to put American back to work, but instead Cantor prefers to make bogus claims about an election mandate to repeal the health care law. Nevermind that 68% of Americans favor consumer protections such as allowing people under 26 to remain on their parents' plans, and 60% don't want health insurers to turn away sick people. Cantor isn't deterred by facts because his mission is partisan politics, not governing.

And so is this typically understated comment from Boehner:

"I believe that the health care bill that was enacted by the current Congress will kill jobs in America, ruin the best health care system in the world, and bankrupt our country... That means we have to do everything we can to try to repeal this bill and replace it with common sense reforms to bring down the cost of health care."

Wow. Sounds like the end of the world as we know it.

Boehner and his fellow Republican repeal-mongers dismiss economic projections they don't like, such as those showing that the ACA will create millions of new jobs, that the law now requires insurers to use a new minimum acceptable percentage of premium dollars for actual medical care instead of profits and bureaucracy, and that the ACA will reduce the federal budget deficit.

The Republicans are kowtowing to right-wing extremists, corporate executives and billionaire investors who secretly spent millions of dollars to help Republican election campaigns last fall, including deceptive ads attacking the health care law. Those deceptions continue still. The ACA protects consumers from the worst health insurance company abuses and provides seniors with better health care through the Medicare program.

Thankfully Senate Majority Leader Harry Reid and the Democrats in the Senate will stop Boehner in his tracks. However, when you cut through the political hyperbole, the GOP's search-and-destroy mission is serious business. The repeal vote in the House scheduled for next week is part of an all-out assault on the new law in the Congress, the courts and state legislatures. And it's an assault with well-funded corporate sponsors.

Everyone already knows that the Republican Party is a wholly-owned subsidiary of the health insurance industry and other profit-hungry corporations. In case there was any doubt, the Republicans have begun hiring insurance and health care industry lobbyists for key positions on committees and members' staffs. So far, two health care industry lobbyists have joined the powerful House Energy & Commerce Committee, which has jurisdiction over health care legislation. One of them was named staff director. In addition, a top lobbyist from the medical device industry has joined Boehner's staff as policy director, a post he will undoubtedly use to try to roll back the new tax on medical devices that is part of the ACA. Expect to see more hires like these.

If that picture isn't disturbing enough, look at the cynical demagoguery of GOP presidential hopefuls, like Fox News personality and former Arkansas Gov. Mike Huckabee. Huckabee has been running TV commercials trashing the health care law and offering a petition to demand that Congress repeal it. It turns out that Huckabee hired a notorious scam artist to help him with the exploitative ad campaign, which is nothing more than a front to raise money. Three days after Think Progress reported about the scammer, Huckabee was forced to fire the guy. A few months ago, Huckabee, a Baptist minister with a pre-existing condition of his own, said it was OK for health insurance companies to turn their backs on people with pre-existing conditions. Like Boehner, he's the new face of the Republican Party on health care. He works for the insurance industry and other big corporations, not the rest of us.

The interests of middle class and working families are of no concern to Republican Party leaders. To them, it's just smart business to spend political capital on protecting the financial interests of the billionaires and big corporations who make up their base -- the "haves and the have-mores," as President George W. Bush famously described them.

And yet, these are the same Republicans who complain about having to wait a few weeks for their health benefits to take effect while they rush into the 112th Congress with a plan that will revive working families' fear of going bankrupt because of crushing medical expenses and of getting dropped from your insurance if you're sick.

Making Money Scams

My guest on Hedge Fund Radio this week is penny stock trader and Internet entrepreneur, Tim Sykes. Every once in a while I run into a natural born trader, someone who crawls out of the crib quoting options spreads, price earnings multiples, and book values. His first spoken word was “Sell!” While other kids were practicing their ABC’s, Tim was pouring through prospectii.

During his college years, Tim skipped classes and turned a $12,415 Bar Mitzvah gift into $1.65 million by trading the market from his dorm room. By the time he graduated from Tulane in 2003, he was already running his own hedge fund. Barclays Bank rated it the number one short bias fund during 2003-2006.

Tim argues that if you cut through all the hype and manipulation in the penny stock market, it is clear that there are huge opportunities on the short side. Most of the companies trading there are frauds, and most will fail. Mini Enron’s and mini Madoff’s abound.

Defined as trading under $5 a share, these stocks are purchased mostly by individuals desperate for “get rich quick” success. Promoters buy lists of email addresses from major online publishers, sometimes paying millions of dollars, to launch a never ending onslaught of “pump and dump” schemes. Email barrages and Twitter spam have replaced the dinnertime telemarketing calls and junk mail of yore.

The SEC is so inundated with tips on Madoff copycats and competitors ratting out each other, they don’t have time to pursue gripes about $1,000 losses emanating from penny stock scams. It’s like expecting the FBI to pursue shoplifters of 99 cent items from Seven Eleven stores.

Some of the claims made by these bogus IPO’s boggle the imagination. Tim’s favorite was one company’s efforts to promote vitamins infused with stem cells. Another offered a solar spray that turned you house into an energy source. Then there was the BP Gulf oil spill that threw up innumerable crude eating forms of algae. As for my own experience, I’ll never forget the aquaculture farm in the middle of the Saudi Arabian desert. To separate out the obvious rip offs from the legitimate companies, Tim spends hours a day gleaning through voluminous SEC filings, some of which are blatant cut and paste jobs from earlier failed floatations.

Even though most of these companies are fake, prices can run away to the upside, wiping out the early short sellers. So some risk control discipline is required. When a stock truly rockets, “buy-ins” of shorts can also be a problem. A few hundred penny stocks are launched each year, but only about five a month catch on fire. And remember, Apple (AAPL), and True Religion (TRLG) jeans were once penny stocks.

To avoid being taken to the cleaners by unscrupulous con men, Tim offers some very basic advice. If it is too good to be true, it generally is. It also helps to read the SEC filings, which can be obtained online for free.

Tim claims to have a success rate with his short strategy of 75%, which has delivered a 56% return in 2010, proving he still has the golden touch. His problem is that the strategy is not scalable, and can only be executed with a small amount of money. No mega hedge fund for him.

That’s why Tim has turned to online education instead of ramping up a big hedge fund. Today, he is offering several subscription newsletters, trade alerts, chat rooms, along with a DVD course on making money in the penny stock market at his website at http://www.timothysykes.com/ .

Obama is history!

Obama was always a one term show!

any political strategist knows few black candidates win statewide re-elections, no black candidates wins re-election win he or she pisses off their liberal base.

Obama was always a Clarence Thomas Clone, Obama knew that a black conservatives never would win the White House, so he done a Reagan, “ACTED” like he was a Democrat. (Reagan acted like he was a President, History will say Reagan started the decline of the USA)

The MSM final act with OBAMA is to make sure no real Democrats primary this clown! (the games have already begun, listen closely, Obama always beats Palin, does Obama beat Romney? NO!!!)

the target of the intelligent left should be the 23 democrat senators up for re-election in 2012! Why? it is very simple, these Senators want to win re-election, (the intelligent left must get ahead of the KABUKI game, Obama is old news, attack the 23 Dems up for re-election in 2012! and you may force them to dump OBAMA)

The left must tie OBAMA around the necks of all these Senators up for re-election! Obama is already TOXIC, make him NUCLEAR WASTE and the Dem Senators will force a primary of OBAMA!

Listed below is the OBAMA necklace that all Dems Senator must wear in 2012

1st Obama endorses the Bush agenda of spying on and killing americans

bank foreclosure

Obviously for REO there will be two peaks. The first was in late 2008 and largely private-label securities and subprime, and the 2nd will probably be in 2011 and be heavily GSE REOs.

The height of the 2nd peak depends on the number of foreclosures, and the how quickly the lenders can sell the REOs. The foreclosure-gate related moratoriums have slowed the foreclosure process, but foreclosures will probably pick up again in early 2011. My guess is the 2nd peak will happen in 2011 and be close to the same height as in 2008.

One of the key issues is the number of delinquent loans (and loans in the foreclosure process). I use the Mortgage Bankers Association (MBA) quarterly data and LPS Applied Analytics monthly data to track delinquencies.

Click on graph for larger image in graph gallery.

This graph based on the MBA quarterly data shows the percent of loans delinquent by days past due. The MBA reported that 13.52 percent of mortgage loans were either one payment delinquent or in the foreclosure process in Q3 2010 (seasonally adjusted). This was down from 14.42 percent in Q2 2010.

Most of the decline in the overall delinquency rate was in the seriously delinquent categories (90+ days or in foreclosure process). Part of the reason is lenders were being more aggressive in foreclosing in Q3 (before the foreclosure pause) - hence the surge in REO inventory in the first graphs! Some of the decline was probably related to modifications too.

This graph provided by LPS Applied Analytics shows the percent delinquent, percent in foreclosure, and total non-current mortgages through November.

The percent in the foreclosure process is trending up because of the foreclosure moratoriums.

According to LPS, 9.02% of mortgages are delinquent (down from 9.29% in October), and another 4.08% are in the foreclosure process (up from 3.92% in October) for a total of 13.10%.

With falling house prices, the delinquency rate could start rising again since more homeowners will have negative equity. However just because a homeowner has negative equity doesn't mean they will default. It usually takes another factor such as loss of employment, divorce, or a medical emergency for the homeowner to default.

On the other hand, an improving labor market will help push down the delinquency rate. My guess is the overall delinquency rate has peaked, although I expect the delinquency rate to stay elevated for some time.

Ten Questions:

• Question #1 for 2011: House Prices

• Question #2 for 2011: Residential Investment

• Question #3 for 2011: Delinquencies and Distressed house sales

• Question #4 for 2011: U.S. Economic Growth

• Question #5 for 2011: Employment

• Question #6 for 2011: Unemployment Rate

• Question #7 for 2011: State and Local Governments

• Question #8 for 2011: Europe and the Euro

• Question #9 for 2011: Inflation

• Question #10 for 2011: Monetary Policy

We asked readers to sign a letter to Iowa attorney general Tom Miller, who is leading the 50 state probe into foreclosure and mortgage abuses. Here is the official report from National People’s Action, which was part of the group that met with Miller earlier today:

Leader of 50 State Foreclosure Probe Tells Struggling Homeowners: “We Will Put People in Jail”

Iowa’s Attorney General Miller also agreed that principal reductions, loan modifications, and compensation for defrauded homeowners are all on his agenda

The lead Attorney General in the 50-state foreclosure investigation, Iowa’s Tom Miller, told homeowners at risk of foreclosure today that he supports a settlement with the big banks that requires significant principal rate reductions, loan modifications, compensation for citizens defrauded of their homes, and criminal prosecutions against big bank executives who broke the law.

“We will put people in jail,” Miller said, in response to questioning. “One of the main tools needs to be principal reductions, just like in the farm crisis in the 1980s…There should be some kind of compensation system for people who have been harmed…And the foreclosure process should stop while loan modifications begin. To have a race between foreclosures and modifications to see which happens first is insane.”

Attorney General Tom Miller met Tuesday with more than 100 people from 15 states representing community, faith, and labor organizations, foreclosure victims and struggling homeowners from across the country. Participants urged Tom Miller to make a strong settlement that includes loan modification and principal reduction as the primary tools for cleaning up the mortgage mess created by the banks.

Miller also agreed to continue to work with grassroots community, faith, and labor groups from across the country and agreed that the Bank Accountability Campaign’s members are stakeholders who deserve a seat at the table.

“We are very pleased with how this meeting turned out and now our expectations are higher than ever,” said Deacon Mike McCarthy, an Iowa Citizens for Community Improvement (Iowa CCI) member from Des Moines, IA.

“Attorney General Miller made it clear that he sees this investigation as a chance to clean up the foreclosure crisis that has ransacked our communities for over three years now and continues to push down housing values for everyone. He stated that loan modifications will be a core component in any settlement,” said Gina Gates, a foreclosure victim with PACT-PICO in San Jose, California.

“The stakes are high. A strong settlement is the best hope to hold Wall Street banks accountable and prevent millions more Americans from losing their homes,” said Mikael Broadway, from IAF in North Carolina.

“The big banks have repeatedly weakened efforts to get to the root of the foreclosure crisis,” said Shirley Broomfield, a struggling homeowner from Melbourne, Florida who is working two jobs to pay her mortgage. “They’ve failed to live up to their promises and outright ignored the rules of the game, with little to no consequences. The Attorneys General have a chance to change this.”

This is the first of a series of similar meetings with the state Attorneys General who are on the investigation’s executive committee. Participants in the meeting included borrowers who have lost their homes unjustly, other homeowners in danger of foreclosure, clergy and community advocates from 15 states – including Iowa, California, Illinois, Washington, New York, Colorado, Ohio, North Carolina, Florida, Missouri, Massachusetts, Kansas, Michigan, Montana and Oregon. The participants presented a stack of homeowner testimonies to Mr. Miller and made it clear that this investigation is their best hope for resetting the housing market and helping millions avoid foreclosure.

The group is staging protests this afternoon at the Wells Fargo Home Mortgage headquarters in West Des Moines and at branch of Bank of America in Des Moines to highlight the massive bonuses that bank executives will receive this month while millions of homeowners face foreclosure. They plan to lift up a new report showing that restoring equity to underwater homeowners would cost the big banks $73 billion, approximately one-half this year’s bonus & compensation pool. Similar protests will take place this week in New York and California.

The growing activity from homeowner groups comes amidst a turbulent time for big banks, especially Bank of America, with both investor lawsuits and the Attorneys General investigation pending, and some analysts beginning to predict the eventual need to restructure America’s largest bank in 2011.

The meeting with AG Miller and other events this week are organized by PICO National Network, National People’s Action, SEIU, Alliance of Californians for Community Empowerment, Alliance for a Just Society, and IAF Southeast.

Yves here. This is certainly good news, since the public can hold Miller’s feet to the fire if he fails to live up to these commitments. One concern I have is that the standard for fraud under the law, as opposed to from a common-sense perspective, is stringent, which means it is extremely difficult to prove. Remember Joe Cassano of AIG, the head of AIG’s financial products group? An investigation of him did not lead to prosecution, effectively because he has discussed what he was up to with AIG’s accountants. Fraud, as defined under the law, requires intent. So perversely, “I thought this was kosher” will get you out of a fraud charge.

We have a short form discussion in ECONNED as to how various laws and regulations were weakened over the 1990s to make it very difficult to prosecute financial fraud successfully. You can find a full treatment in Frank Partnoy’s book Infectious Greed.
